These Terms & Conditions ("Terms") govern your access to and use of InflowsWeb ("InflowsWeb," "we," "us," or "our"), including our website, InflowsWeb.com, and our website design and digital marketing services, which may be delivered in part through our customer relationship management and marketing platform, GoHighLevel, and through third-party communication channels such as Instagram and Facebook Messenger. By accessing our website, engaging our services, or providing your contact information to us (including by opting in to receive text messages, calls, or other communications), you agree to be bound by these Terms.

1. Agreement to Terms

By using our website or engaging InflowsWeb for website design, marketing, or related services, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, available at https://inflowsweb.com/privacy-policy-page. If you do not agree to these Terms, please do not use our website or services.

You represent that you are at least 18 years old and, if you are accepting these Terms on behalf of a business, that you have the authority to bind that business to these Terms. We may update these Terms from time to time; continued use of our website or services after changes take effect constitutes acceptance of the revised Terms (see Section 13).

2. Description of Services

InflowsWeb provides website design, development, hosting coordination, and digital marketing services to small and local businesses. Our services may include, without limitation:

- Custom website design, development, and maintenance.

- Search engine optimization and local marketing strategy.

- Marketing automation, lead follow-up, and client communications delivered through GoHighLevel.

- Communications with you by text message, email, phone call, and social messaging channels such as Instagram and Facebook Messenger, related to appointments, quotes, account matters, and marketing (where consented to).

Specific deliverables, pricing, and timelines for any engagement will be set out in a separate proposal, invoice, or service agreement between InflowsWeb and the client, which these Terms supplement.

3. User Responsibilities

When using our website or services, you agree to:

- Provide accurate, current, and complete information, including contact and business information.

- Promptly update your information if it changes, including your mobile phone number, email address, or social media contact details.

- Use our website and services only for lawful purposes and in accordance with these Terms.

- Maintain the confidentiality of any account credentials associated with services we provide on your behalf.

- Be responsible for all activity that occurs through your account or under your direction.

4. Acceptable Use

You agree not to:

- Use our website or services to transmit unlawful, harassing, defamatory, obscene, or fraudulent content.

- Use our services to send unsolicited communications in violation of applicable law, including the Telephone Consumer Protection Act (TCPA) and - - - CAN-SPAM Act.

- Attempt to gain unauthorized access to our systems, GoHighLevel sub-account, or any data not belonging to you.

- Interfere with or disrupt the integrity or performance of our website, services, or underlying platforms.

- Use our services to infringe upon the intellectual property or privacy rights of any third party.

- Reverse engineer, scrape, or resell access to our website or services without our written consent.

We reserve the right to suspend or terminate access to our website or services for any user who violates this Acceptable Use section.

5. Intellectual Property

All content on InflowsWeb.com, including text, graphics, logos, templates, and software, is the property of InflowsWeb or its licensors and is protected by applicable intellectual property laws. Unless otherwise agreed in a separate service agreement:

- Upon full payment for a website design engagement, InflowsWeb grants the client a license to use the final delivered website for its intended business purpose.

- InflowsWeb retains ownership of its underlying design frameworks, templates, tools, and proprietary processes used to build client deliverables.

- Clients retain ownership of their own trademarks, logos, copy, and business content provided to InflowsWeb for use in a project.

- No content from our website or materials may be copied, reproduced, or distributed without prior written permission, except as necessary for your own business's use of a delivered website.

6. Communications & Messaging Terms

InflowsWeb communicates with prospects and clients through several channels, including text message (SMS/MMS), email, phone calls, and social messaging platforms such as Instagram and Facebook Messenger. This section describes the terms that apply to each.

SMS Messaging Terms

Consent & Message Frequency: By providing your mobile phone number and opting in (via a web form, verbal agreement, or other compliant method), you consent to receive text messages from InflowsWeb related to appointments, quotes, account updates, and, where separately consented to, marketing offers. Message frequency varies depending on your interactions with us and the type of messages you have opted in to receive.

Message & Data Rates: Message and data rates may apply to any text messages we send or that you send to us, depending on your mobile carrier and plan. InflowsWeb is not responsible for any charges billed to you by your wireless carrier.

Opt-Out (STOP): You may opt out of receiving text messages from InflowsWeb at any time by replying "STOP" to any message. After you reply STOP, you will receive a one-time confirmation message that you have been unsubscribed, and no further text messages will be sent to you unless you opt back in.

Help (HELP): You may reply "HELP" to any message to receive assistance or additional information about our text messaging program. You may also contact us directly using the information in Section 14.

Carrier Liability Disclaimer: Carriers are not liable for delayed or undelivered messages. InflowsWeb and its carriers make no representations or warranties regarding the timeliness or reliability of message delivery.

Privacy: Information collected in connection with our SMS program, including your mobile number and opt-in consent, is handled in accordance with our Privacy Policy, available at https://inflowsweb.com/privacy-policy-page. No mobile information will be shared with third parties or affiliates for marketing/promotional purposes.

Email Communications

If you provide your email address, InflowsWeb may send you transactional emails (such as quotes, invoices, and appointment confirmations) as well as marketing emails where you have consented to receive them. Every marketing email includes an unsubscribe link; you may opt out of marketing emails at any time by using that link or by contacting us directly. Transactional and account-related emails may continue even after you unsubscribe from marketing emails, as needed to service your account.

Phone Calls

InflowsWeb may call you regarding appointments, quotes, account matters, and, where consented to, marketing offers. You may ask to stop receiving calls at any time by informing us during a call or by contacting us using the information in Section 14, and we will honor that request and update our records accordingly.

Instagram & Facebook Messenger

Where you have messaged InflowsWeb or otherwise interacted with our Instagram or Facebook accounts, we may respond to and communicate with you through those platforms, including for appointment scheduling and, where consented to, marketing purposes. These communications are also subject to the terms and policies of the underlying platform (Meta). You may opt out of receiving messages from us on these platforms at any time by blocking or muting our account, replying "STOP," or contacting us directly using the information in Section 14.

7. Third-Party Platforms & Service Providers

InflowsWeb uses GoHighLevel as a data processor to help operate our customer relationship management, marketing automation, appointment scheduling, and SMS/email/social communication functions. GoHighLevel processes information solely on our behalf and according to our instructions, and does not independently use client or lead data collected through our account for its own marketing purposes.

Our services may also involve third-party platforms such as Instagram and Facebook Messenger (operated by Meta), payment processors, and hosting providers. Those third parties have their own terms of service and privacy policies, which govern your use of their platforms independently of these Terms. InflowsWeb is not responsible for the practices, availability, or content of any independent third-party platform or service.

8. Disclaimers

Our website and services are provided on an "as is" and "as available" basis, with all faults and without warranty of any kind. To the fullest extent permitted by applicable law, InflowsWeb disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website or services will be uninterrupted, timely, secure, or error-free, or that any specific marketing or business results (such as search rankings, lead volume, message deliverability, or revenue) will be achieved from our services.

9. Limitation of Liability

To the fullest extent permitted by applicable law, InflowsWeb and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages. In no event shall InflowsWeb's total aggregate liability arising from these Terms or our services exceed the total amount paid by you to InflowsWeb for the services giving rise to the claim in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above exclusions and limitations may not apply to you. In those jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.

10. Dispute Resolution

If you have a concern or dispute about our services, you agree to first contact InflowsWeb and attempt to resolve the dispute informally. Most concerns can be resolved this way.

If a dispute cannot be resolved informally within sixty (60) days, you and InflowsWeb agree that any dispute arising out of or relating to these Terms or our services will be resolved by binding, individual arbitration, and you and InflowsWeb each waive the right to a jury trial and to participate in a class, collective, or representative action. This arbitration provision does not apply to small claims court actions or to either party's right to seek injunctive relief for intellectual property infringement or unauthorized use of our systems.

You may opt out of this arbitration agreement by sending written notice to the mailing address in Section 14 within thirty (30) days of first agreeing to these Terms. If you opt out, disputes will instead be resolved in the courts identified in Section 11.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Subject to Section 10 (Dispute Resolution), any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

12. Termination

We may suspend or terminate your access to our website or services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our website or services will cease immediately, though any provisions of these Terms that by their nature should survive termination (including Sections 5, 8, 9, and 10) will continue to apply.

13. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. If a revision is material, we will make reasonable efforts to provide at least thirty (30) days' notice before the new terms take effect. The "Effective Date" at the top of this page indicates when these Terms were last revised. Your continued use of our website or services after any changes take effect constitutes your acceptance of the revised Terms.
